Client Rights
Charlie Health acknowledges and upholds the following client rights for services provided in Colorado, in addition to the patient rights required by The Joint Commission (TJC).
Colorado Client Rights:
You have the right to:
- Participate in all decisions involving the individual’s care or treatment.
- Be informed about whether the BHE is participating in teaching programs, and to provide informed consent prior to being included in any clinical trials relating to the individual’s care.
- Refuse any drug, test, procedure, service, or treatment and to be informed of risks and benefits of this action.
- Receive care and treatment, in compliance with state statute, that is free from discrimination on the basis of physical or mental disability, race, ethnicity, socio-economic status, religion, gender expression, gender identity, sex, sexuality, culture, and/or languages spoken; and that recognizes an individual’s dignity, cultural values and religious beliefs; as well as provides for personal privacy to the extent possible during the course of treatment.
- Be informed of, at a minimum, the first names and credentials of the personnel that are providing services to the individual. Full names and qualifications of the service providers must be provided upon request to the individual or the individual’s designated representative or when required by the department of regulatory agencies.
- Receive, upon request:
- Prior to initiation of non-emergent care or treatment, the estimated average charge to the individual. This information must be presented to the individual in a manner that is consistent with all state and federal laws and regulations.
- The BHE’s general billing procedures.
- An itemized bill that identifies treatment and services by date. The itemized bill must enable individuals or their legal representatives to validate the charges for items and services provided and must include contact information, including a telephone number, for billing inquiries. The itemized bill must be made available either within ten (10) business days of the request, thirty (30) days after discharge, or thirty (30) days after the service is rendered – whichever is later.
The Joint Commission: Rights & Responsibilities of the Individual
You have the right:
- To accept or refuse treatment after receiving this explanation.
- To a humane environment that provides reasonable protection from harm and appropriate privacy for your personal needs.
- To be free from any abuse, neglect, and exploitation.
- To be treated with dignity and respect.
- To have services provided by appropriate number of skilled, qualified and experienced professionals to implement and oversee your treatment plan
- To be told about the program’s rules and regulations, and possible outcomes for violating rules, before you are admitted.
- To be told before admission:
- the condition to be treated;
- the proposed treatment;
- the risks, benefits, and side effects of all proposed treatment and medication;
- the probable health and mental health consequences of refusing treatment;
- other treatments that are available and which ones, if any, might be appropriate for you; and
- the expected length of stay.
- To a treatment and discharge plan designed to meet your needs, as well as the right to take part in developing that plan.
- To meet with staff to review and update the plan on a regular basis.
- To involve your family in decisions about care, treatment, or services.
- To refuse to take part in research without affecting your regular care.
- To have information about you kept private and to be told about the times when the information can be released without your permission.
- To make a complaint and receive a fair response from the facility within a reasonable amount of time.
- To complain directly to the State agency that oversees this facility.
- To get a copy of these rights before you are admitted, including the address and phone number of the State agency which oversees this facility.
- To have your rights explained to you in simple terms, in a way you can understand, within 24 hours of being admitted.
- To be free from discrimination, intimidation, or harassment based on sex, race, color, religion, ancestry, national origin, disability, medical condition or sexual orientation or perception of having one or more of those characteristics. The organization respects the cultural and personal values, beliefs, and preferences of the individual served.
- To access and request your records or amendments to your clinical/case information.
- To obtain interpreting and translation services, as necessary.
- To request the opinion of a consultant.
- To request your treatment plan be reviewed by the medical director or designee.
- To be told in advance of all estimated charges and, as appropriate, the itemized cost of services.
- To be told, in advance, about the use of recording devices or services used during treatment.
- To have professionals involved in your treatment take part in ongoing trainings specific to the principles of confidentiality, professional boundaries, and Client rights
- To give or withhold informed consent to treatment.
- To receive information about the staff responsible for his or her care, treatment, or services.
- To access protective and advocacy services.
